How to submit a takedown notice or counter-notification to NovaOTT Media, and how we handle repeat infringement.

NovaOTT Media respects the intellectual property rights of content creators and rights holders. We comply with the Digital Millennium Copyright Act (DMCA) and with equivalent copyright legislation applicable in Canada. This page explains how we handle copyright infringement claims.

1. Our licensing position

NovaOTT operates as a reseller of IPTV subscription services and does not host, store or originate the content delivered through the Service. All channels and video-on-demand titles are sourced from content providers and distributors. We are committed to ensuring our operations respect applicable copyright law, and we act on valid notices promptly. Subscriber obligations on redistribution are set out in our service terms, and how we handle personal data during a claim is covered by the privacy notice.

2. Submitting a takedown notice

If you are a copyright owner or an authorised agent and believe content accessible through https://novaott.ca infringes your copyright, send a written notice to our designated agent. A valid notice must contain all of the following:

  1. Identification of the copyrighted work — a description of the work you claim has been infringed. Where multiple works are covered, a representative list is acceptable.
  2. Identification of the infringing material — the specific URL or enough information for us to locate the material on https://novaott.ca.
  3. Your contact information — full name, mailing address, telephone number and email address.
  4. Good faith statement — a statement that you believe in good faith the use is not authorised by the copyright owner, its agent or the law.
  5. Accuracy statement — a statement that the information is accurate and, under penalty of perjury, that you are authorised to act for the copyright owner.
  6. Signature — your physical or electronic signature.

We acknowledge valid notices within 5 business days and take appropriate action, which may include disabling access to the material and notifying the relevant content provider.

3. Counter-notification

If you believe material was removed or disabled as a result of a mistake or misidentification, you may send a written counter-notification to [email protected] containing:

  1. Identification of the removed content — a description and the location of the material before removal.
  2. Statement under penalty of perjury — that you believe in good faith the material was removed as a result of mistake or misidentification.
  3. Your contact information — full name, address, telephone number and email address.
  4. Consent to jurisdiction — that you consent to the jurisdiction of the courts of Canada and will accept service of process from the party who filed the original notice.
  5. Signature — your physical or electronic signature.

On receipt of a valid counter-notification we forward it to the original complainant. If no court action is filed within 10 to 14 business days, we may restore the material at our discretion.

4. Repeat infringer policy

NovaOTT maintains a strict policy on repeat infringement. Accounts subject to multiple valid copyright notices are reviewed; we reserve the right to terminate subscriptions of users determined to be repeat infringers. Termination for repeat infringement does not entitle the user to a refund, consistent with our terms of service.

5. Misuse of the takedown process

Filing a false notice is a serious legal matter. Under the DMCA (17 U.S.C. § 512(f)) and equivalent legislation, anyone who knowingly misrepresents that material is infringing may be liable for damages, including costs and legal fees.
